A MAN accused of threatening a leisure centre supervisor with a handgun during a burglary is to be retried.
A jury could not reach a verdict in the trial of Tommy Munro, who denies aggravated burglary and possessing a knife on September 9 2006.
Munro entered Blackshots Leisure Centre, Grays, at 3.52pm on the day of the incident but was not seen leaving when it closed at 5.30pm.
At 9.10pm, after having disguised himself by wearing a black balaclava, Munro is said to have threatened David Warner, a supervisor, with a handgun.
Munro, of no fixed abode, claims he fell asleep in the changing room toilets after feeling unwell but later let himself out of a fire exit.
He appeared at Basildon Crown Court yesterday (Wednesday) where Judge Rupert Overbury discharged the jury.
There will be a retrial following a preliminary hearing at Basildon Crown Court on January 24.
Munro was remanded in custody.
