GRAYS Athletic defender Jon Ashton has been ordered to appear before a court in Scotland - after twice failing to turn up for his trial.

He was arrested last year while playing for the England non-League side in Scotland.

His partner in the alleged crime was Dagenham and Redbridge player Danny Foster, who also twice failed to appear at court though his club did send in a fax claiming he could not travel due to injury.

The footballers allegedly danced in a street of a Highlands town after wrapping themselves in lager advertising banners.

Former Leicester City, Oxford United and Rushdon and Diamonds player Ashton, 25, and Foster, 23, a former captain of Tottenham Hotspurs' youth team, each face three counts of vandalism.

It was alleged they took down banners outside Aviemore's Cairngorm Hotel, the base of the Highland Tartan Army.

Foster and Ashton also allegedly damaged an information board outside the hotel, used by Highlands based supporters of Scotland's national football team.

It is claimes they then went to the nearby Macdonald Aviemore Highland Resort and took down two more advertising banners.

The vandalism was said to have been carried out on May 28 last year.

Ashton started his career with Leicester City before moving to Notts County.

He then joined Oxford Utd, moved to Rushden and Diamonds, and now plays with Conference League side Grays Athletic.

Justices have ordered both Foster and Ashton to appear at the court next month - or provide independent medical evidence proving they are unfit to travel.

A trial is set down for June 25.
